All services are provided based on agreed proposals, quotations, or contracts.

3. Quotations & Payments

  • All pricing is provided in written quotations or proposals.

  • A deposit may be required before project commencement.

  • Final payment terms will be defined in the project agreement.

  • Late payments may result in project delays or suspension of services.

We reserve the right to revise pricing for ongoing or extended work outside the original scope.

4. Project Scope & Revisions

  • Work will be delivered as per the agreed scope of work.

  • Any additional requests outside the agreed scope may incur extra charges.

  • Reasonable revisions are included as per the proposal. Excessive revisions may be chargeable.

5. Client Responsibilities

The client agrees to:

  • Provide accurate information and content required for the project

  • Respond to feedback requests within reasonable timeframes

  • Ensure they have rights to any materials provided (logos, images, content, etc.)

We are not responsible for delays caused by late client responses.

6. Intellectual Property

  • Upon full payment, final approved deliverables become the property of the client (unless otherwise stated in writing).

  • We reserve the right to showcase completed work in our portfolio unless a confidentiality agreement is in place.

  • Draft concepts and unpaid work remain our intellectual property.

7. Marketing & Performance Disclaimer

For digital marketing services:

  • We do not guarantee specific rankings, sales numbers, or revenue outcomes.

  • Marketing performance depends on multiple external factors beyond our control (competition, industry trends, algorithms, etc.).

We commit to using best industry practices and strategic execution.

8. Confidentiality

Both parties agree to maintain confidentiality of sensitive business information shared during the project.

9. Limitation of Liability

To the maximum extent permitted by law:

  • FeniQue DigiTech shall not be liable for indirect, incidental, or consequential damages.

  • Our total liability shall not exceed the amount paid for the specific service in question.

10. Third-Party Services

We may use third-party tools, hosting providers, advertising platforms, or payment gateways.

We are not responsible for outages, errors, or changes made by third-party providers.

11. Termination

Either party may terminate services with written notice.

If terminated:

  • Work completed up to the termination date will be billed accordingly.

  • Deposits may be non-refundable depending on project stage.

12. Website Use

You agree not to:

  • Misuse our website

  • Attempt unauthorized access

  • Copy or reproduce website content without permission

13. Governing Law

These Terms are governed by the laws of Australia.
Any disputes will be subject to the jurisdiction of Australian courts.
